1. Acceptance of Terms

By accessing or using the ServMon service ("Service") operated by ServMon ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ServMon is a server and website monitoring platform that provides uptime monitoring, performance metrics, SSL certificate monitoring, alert notifications, and public status pages. The Service is accessed via our web application at portal.servmon.com, our API at api.servmon.com, and our server monitoring agent.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You are responsible for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as needed to keep it accurate.

4. Subscription and Billing

The Service is offered under subscription plans with different feature limits. Plan details and pricing are available on our website. By subscribing to a paid plan, you agree to pay the applicable fees.

• Subscriptions are billed monthly or annually, depending on your selected billing cycle.
• Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method.
• You may upgrade, downgrade, or cancel your subscription at any time from your account settings.
• Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored until the end of their current billing period.

5. SMS Notifications

By adding a phone number and enabling SMS notifications in your account settings, you expressly consent to receive automated text messages from ServMon related to monitoring alerts for servers and websites you have configured. These messages are transactional and operational in nature.

• Message frequency varies based on your monitoring configuration and alert activity.
• Message and data rates may apply depending on your mobile carrier.
• You may opt out at any time by replying STOP to any SMS message or by removing your SMS notification channel in your account settings.
• Reply HELP to any message for assistance, or contact support@servmon.com.
• SMS is not available in all countries. Supported carriers include major US carriers.

We will not use your phone number for marketing or promotional messages. SMS notifications are limited to monitoring alerts and account security notices.

6. Acceptable Use

You agree not to:

• Use the Service to monitor servers or websites that you do not own or have authorization to monitor
• Attempt to circumvent usage limits or security measures
• Use the Service for any illegal purpose or in violation of any applicable laws
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute the Service without our written consent

7. API Keys and Agent Access

API keys and server agents are provided for programmatic access to the Service. You are responsible for keeping your API keys secure. If you believe an API key has been compromised, you must revoke it immediately from your account settings.

We are not responsible for any unauthorized access resulting from compromised API keys or agent credentials.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

9. Data Ownership

You retain ownership of all data you submit to the Service, including monitoring configurations and collected metrics. We claim no intellectual property rights over your data. You grant us a limited license to use your data solely to provide and improve the Service.

10. Limitation of Liability

To the maximum extent permitted by law, ServMon and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is a monitoring and notification tool. We are not responsible for any damages resulting from server outages, security incidents, or other events that our monitoring detects or fails to detect.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 30 days after termination for backup purposes, after which it will be deleted.

13. Indemnification

You agree to indemnify and hold harmless ServMon from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ServMon operates, without regard to conflict of law principles.
